SOUTH DAKOTA CHISLIC FESTIVAL FOOD VENDOR RULES AND STANDARDS

  1. Each vendor must submit a full application and will be reviewed by the vendor committee of the South Dakota Chislic Festival (SDCF). Applications will be processed in the order they are received. Previous years’ exhibitors will be given preference if they have met our expectations and complied with the regulations set forth here. Vendors confirmed in 2023 will be given first right of refusal for the 2024 festival. The remaining available spaces will then go to new applicants, with preference given to vendors from the Chislic Circle. Remaining vendors will be chosen based on the needs of the festival; duplicate menu items will be limited  and the SDCF committee MUST approve all menu items served. Food vendors are NOT permitted to sell or provide beverages without prior approval from the SDCF committee. 

  2. Single booth spaces are 12’X12’ at $225 each. Vendors should fit into their designated area without crowding, wasting space, or infringing on adjoining vendors’ ability to conduct business. If additional space is required, additional 12’x12’ space(s) may be purchased at the same price. Additional space requests are due with the initial application. 

  3. Space assignments are made by SDCF vendor committee members. Vendors are restricted to setting up only in the space designated for them by SDCF: violators will be asked to leave, will forfeit all fees, and will not be allowed to participate in future SDCF events. No vehicles (except food trucks) will be allowed in the booth space unless previously approved.  A nearby parking area will be available to the vendors (limit one vehicle per vendor).

  4. Vendors are required to be open for business during the entirety of festival hours. Vendors should provide a good example of commerce for the community, with reputable products represented in a wholesome, businesslike manner. Booths should be attractive and neatly arranged, utilizing professional display techniques with appropriate signage indicating who the vendor is, what they are offering, prices, etc. Loud speakers or megaphone devices are not allowed. Vendors must prepare for the possibility of inclement weather conditions, such as rain or wind.

  5. Basic power is available on a first-come, first-served basis at an additional cost of $50. Exhibitors are required to supply their own means of attaching to the supply point, including at least 150 feet of cord. Please inspect cords and connections prior to the festival to avoid power problems. Food trucks will be responsible for their own power, run on their own generators.

  6. Water will be provided, HOWEVER vendors must provide their own way to transport it from the source to their booth and to heat it.

  7. Vendors must follow all Department of Health guidelines including providing some form of covering under their booth to prevent damages to the property. Vendors are asked to be mindful that the festival is located on the grounds of an arboretum and to leave the space as it was found. Waste should be disposed of in appropriate areas, in compliance with state and local laws. Grease waste must be removed from the premises. Vendors are responsible for their own waste and must dispose of it properly.

  8. Booth fees are due at the time of application. An accepted application is a commitment to attend the festival and constitutes an agreement between the vendor and SDCF. All requests or special needs must be made in writing and received with the completed application. All efforts will be made to honor such requests; however, SDCF cannot guarantee that all requests will be granted. Venmo is now available to pay these fees!

9. No refunds will be made for cancellation or inclement weather: NO EXCEPTIONS.

10. No Promotional items may be given away that directly conflict with items sold by or through the South Dakota Chislic Festival (including but not limited to
beverages and apparel).  Please contact the Vendor Committee if you believe your product may be a conflict.

If you are selected as a vendor, and you elect to participate, booth fees are payable no later than APRIL 1st, 2024. They are non-refundable.

By participating in the South Dakota Chislic Festival, vendors consent that their images may be used for SDCF publicity, including any social media outlets.

All vendors certify that they will cooperate with all standards and procedures, insurance requirements, and all state and city laws and ordinances pertaining to food service and tax reporting. Vendors are responsible for reporting their own applicable taxes, including income, state and local sales tax.

Vendors bear the responsibility for all setup and security needs for their booths. SDCF will not be responsible for any loss or damage to any of the vendor’s property, or any damage or loss sustained by a third party due to installation or setup by the vendor.

Vendors further agree to indemnify, defend and hold harmless the South Dakota Chislic Festival from any and all claims, demands, loss or liability of every nature, for injuries to persons and/or property, occurring in or about or in any way connected with this Application or Agreement, the South Dakota Chislic Festival, or their services or any performance of their obligations under this Application or Agreement, to the extent such claims, demands, loss or liability arise out of the negligence or failure of the exhibitor, its officers, agents, employees, representatives, vendors, subcontractors, assigns, licensees, and/or invitees. In the event of any claims, demands, loss or liability arising under this section and their duty to defend, the exhibitor’s responsibility shall include the payment of all reasonable attorney’s fees and all costs of defense and/or litigation, mediation, arbitration, or any other similar claims process initiated under this section.

If you are selected as a vendor, and you elect to participate, booth fees are payable and prefer no later than April 1st, 2024. They are non-refundable.

By submitting the application, the food vendor agrees to the following:

  1. To read, understand, and follow the SDCF Food Vendor Rules and Standards.

  2. To comply with all federal, state, and parish laws. Food vendors must comply with the South Dakota Health Department rules and regulations.

  3. Lack of: courtesy, good will, and/or good taste, toward an attendee or staff could result in termination of this agreement, loss of the vendor’s deposit, and eviction from the festival area. Vendors in violation of this agreement may lose ability to return to the festival in future years at the discretion of the Vendors Committee.

  4. This application, if accepted, will serve as a contract and any legal fees incurred by anyone because of this contract will be paid for by the losing party.

  5. Each food vendor agrees to indemnify, defend, and hold harmless the South Dakota Chislic Festival (SDCF) from any and all claims, demands, loss or liability of every nature, for injuries to persons and/or property, occurring in or about or in any way connected with this Application or Agreement, the SDCF, or their service or any performance of their obligations under this Agreement or Application, to the extent such claims, demands, loss or liability arise out of the negligence or failure of the exhibitor, its officers, agents, employees, representatives, vendors, subcontractors, assigns, licensees, and/or invitees. In the event of any claims, demands, loss or liability arising under this section and their duty to defend, the exhibitor’s responsibility shall include the payment of all reasonable attorney’s fees and all costs of defense and/or litigation, mediation, arbitration, or any other similar claims process initiated under this Section.

  6. Each food vendor shall obtain commercial, general, or comprehensive liability insurance including product liability insurance applicable during vendor’s operations at South Dakota Chislic Festival insuring those operations with limits of not less than $1,000,000 per occurrence and name South Dakota Chislic Festival as an additional insured.

  7. Each food vendor shall furnish South Dakota Chislic Festival with evidence of such insurance no later than June 15th. If proof of liability insurance is not provided by this date, the agreement will be null and void and the vendor’s booth space and deposit fees will be forfeited. South Dakota Chislic Festival shall have no obligation whatsoever to insure, provide, or obtain insurance for the food vendor. Vendor will not be permitted to enter the Festival grounds to set up or occupy booth space without having the required insurance in place.

  8. Each food vendor is responsible for paying the sales tax on their food sales.

  9. This contract specifies the Vendor’s understanding and acceptance of all requirements and my commitment to provide the agreed upon items for sale at South Dakota Chislic Festival during the hours of the festival (regardless of weather or other circumstances).

  10. Each food vendor agrees that no substitutions to the menu may be added without prior written approval, and that any attempt on my part to make substitutions may result in the immediate termination of my participation and forfeiture of all fees.

  11. Each food vendor agrees to meet the requirements set forth by the health department and operate their booth in compliance with such regulations. The Vendor will conduct operations in a safe manner at all times. The Vendor agree to maintain their booth in a clean manner and will keep the area neat and pleasant for the customers.

  12. This application encompasses the entire agreement of the Applicant and South Dakota Chislic Festival, and shall not be modified unless mutually agreed upon in writing. This agreement constitutes a legally binding contract, and all terms, conditions, and provisions set forth shall have full force and effect upon South Dakota Chislic Festival acceptance. The individual signing hereto declares that he/she has full authority on behalf of the named Applicant to bind the Applicant to all terms, conditions, and provisions of this agreement.
